THIS COMES NEARLY THREE AND A HALF YEARS AFTER HE WAS ARRESTED IN RUSSIA, ACCUSED OF DRUG TRAFFICKING FOR POSSESSING MEDICAL MARIJUANA, WHICH WAS PRESCRIBED BY A DOCTOR IN THE U.S. HE鈥橲 GRATEFUL FOR EVERY MOMENT THAT HE IS ALIVE, BUT WE ALL HAVE TO UNDERSTAND. SO THIS IS A 30 YEAR LONG ILLNESS THAT HE HAD SUFFERED FROM. HE HAD MULTIPLE SURGERIES, AND EVEN IN THE BEST OF THE CIRCUMSTANCES, WITHOUT THE PROPER MEDICAL TREATMENT, HIS CONDITION WILL CONTINUE TO DETERIORATE. SO IMAGINE THIS HAPPENING IN A RUSSIAN PRISON CAMP. ATTORNEY SASHA AND EDWARD PHILLIPS SAID A NOW DISMISSED LAWSUIT FILED ON BEHALF OF MORPHINE FOGEL, MARK鈥橲 MOTHER, WHICH INTENDED TO REQUIRE SECRETARY BLINKEN TO REVIEW MARK鈥橲 CASE UNDER THE LEVINSON ACT, APPLIED PRESSURE ALONG WITH THE CONTINUED PUSH FROM THE FOGEL FAMILY AND MEMBERS OF CONGRESS. THE DESIGNATION COMING AS A RELIEF TO MARK鈥橲 FAMILY. A teacher from western Pennsylvania was arrested in Russia in 2021 and had been detained in a prison ever since, until his release Tuesday.Oakmont native Marc Fogel was sentenced to 14 years in a Russian penal colony in 2022 for drug trafficking after he was arrested for possessing medical marijuana, which was prescribed by a doctor in the United States. Fogel鈥檚 mother, Malphine, has been fighting to bring her son home since his arrest. In June 2024, a bipartisan resolution was passed by the Senate calling for his release.At the time, Malphine Fogel told Pittsburgh鈥檚 Action News 4, "He has missed so much with his family. His youngest son graduated from college. Of course, you didn't see that. The birthdays and wedding anniversary, and, you know, it's just really, really hard."Then-Secretary of State Antony Blinken said that when it came to Americans wrongfully detained in Russia and elsewhere, the U.S. was working on the cases 鈥渜uite literally every day."Malphine Fogel filed a lawsuit against Blinken at the end of June, saying the secretary of state had failed to designate her son as "wrongfully detained."Fogel was declared wrongfully detained last year.
