AND THANKS SO MUCH FOR JOINING US HERE AT 6:00. I鈥橫 JARVIS ROBERTSON AND I鈥橫 GLADYS BAUTISTA. TONIGHT, THE MAN CHARGED WITH CARRYING OUT A DEADLY MASS SHOOTING IN FIVE POINTS SOUTH, MAKING HIS FIRST COURT APPEARANCE. POLICE SAY DAMIEN MCDANIEL WAS ONE OF THE SHOOTERS THAT KILLED FOUR PEOPLE AND WOUNDED 17 OTHERS. POLICE SAY THIS ISN鈥橳 THE ONLY HOMICIDE MCDANIEL IS CONNECTED TO. NOW WE HAVE TEAM COVERAGE ON THIS TONIGHT. LET鈥橲 BEGIN WITH 米兰体育 13 S LISA CRANE LISA, HOW MANY CASES IS MCDANIEL CONNECTED TO? WELL, BIRMINGHAM POLICE SAY DAMIEN MCDANIEL KILLED SIX PEOPLE IN JUST OVER 72 HOURS. LET鈥橲 BREAK DOWN THE TIMELINE OF WHEN THEY SAY THIS ALL UNFOLDED. NOW, INVESTIGATORS SAY ON SEPTEMBER 19TH, MCDANIEL OPENED FIRE INTO THE 604 BAR AND LOUNGE ON NINTH STREET NORTH, KILLING A WOMAN NAMED ANTOINETTE BROWN. THEN TWO DAYS LATER, THEY SAY MCDANIEL ONCE AGAIN OPENED FIRE AS DOZENS WERE WAITING OUTSIDE HUSH LOUNGE, KILLING FOUR PEOPLE AND INJURING 17. EXCUSE ME. THEN, ON SEPTEMBER 22ND, HE ALLEGEDLY. SHOT THREE PEOPLE ON 81ST PLACE SOUTH AZJA MARKUS MCINTYRE DIED FROM HIS INJURIES. MCDANIEL HAD HIS FIRST COURT APPEARANCE TODAY AND ZOE BLAIR WAS ACTUALLY IN COURT WITH HIM. SHE JOINS US NOW LIVE. ZOE, WHAT HAPPENED? LISA THAT鈥橲 RIGHT. I WAS IN THAT COURTROOM FOR MCDANIEL鈥橲 FIRST APPEARANCE TODAY. THE JUDGE BROKE DOWN THE 22 CHARGES. HE鈥橲 FACING FROM THAT 72 HOUR WINDOW. YOU JUST TOLD US ABOUT WHEN THOSE CRIMES WERE COMMITTED. WE ALSO LEARNED ABOUT TWO OTHER CHARGES HE鈥橲 FACING FROM CRIMES COMMITTED JUST LAST WEEK. THOSE WERE FOR UNLAWFUL POSSESSION OF MARIJUANA AND UNLAWFUL POSSESSION OF A FIREARM. THOSE CHARGES WERE FILED LAST FRIDAY. NOW, THIS WASN鈥橳 MCDANIEL鈥橲 FIRST TIME IN A COURTROOM. HE WAS CONVICTED IN BESSEMER FOR TWO COUNTS OF ATTEMPTED MURDER BACK IN 2019. IN THAT CASE, HE WAS ORIGINALLY SENTENCED TO 13 YEARS, BUT WAS LET OUT AFTER SERVING ONLY TWO OF THEM. LIKE LISA SAID, MCDANIEL IS ONE OF FOUR PEOPLE FACING CAPITAL MURDER CHARGES IN THE COMMISSION OF A ROBBERY FOR THE DEATH OF JAMARCUS MCINTYRE. LARRY ROLLINS, ANOTHER SUSPECT IN THAT CASE, WAS ALSO SET TO APPEAR IN THAT SAME COURTROOM TODAY. TO BE APPOINTED A PUBLIC DEFENDER. LAST NIGHT, ROLLINS OBTAINED A LAWYER, SO HE DID NOT APPEAR TODAY. NOW, HIS ATTORNEY WAS IN THAT COURTROOM AND WE SPOKE WITH HIM AS HE CAME OUT RATHER THAN JUST ADOPT THE NARRATIVE OF THE STATE AT THIS POINT OR THE POLICE. LET鈥橲 WAIT AND SEE WHAT THE FACTS ACTUALLY SHOW. I DON鈥橳 THINK THAT THEY鈥橰E GOING TO SHOW EXACTLY WHAT THEY SAY. MR. ROLLINS HAS ALWAYS MAINTAINED HIS INNOCENCE FOR WHAT HE WAS ACQUITTED OF BEFORE AND FOR THE CHARGES NOW. AND ALL WE鈥橰E ASKING IS THAT HE BE TREATED LIKE ANYBODY ELSE IN THIS COUNTRY. AND THAT鈥橲 FAIRLY. NOW, THOSE TWO DOZEN CHARGES MCDANIELS IS FACING BRING HIS BOND TO OVER $1.7 MILLION. EVEN IF HE WAS ABLE TO COME UP WITH THE MONEY TO POST THAT BOND, HE WOULD STILL BE IN JAIL BECAUSE OF THOSE TWO CAPITAL MURDER CHARGES HE鈥橲 FACING WHERE HE DOES NOT QUALIFY FOR BOND IN THOS

BIRMINGHAM, Ala. — The man accused of committing six homicides, including the Five Points South mass shooting, appeared in court for the first time Thursday.
Twenty-two-year-old Damien McDaniel was in a Jefferson County courtroom Thursday morning, less than 24 hours after Birmingham Police announced his arrest.
Judge Maria Fortune read McDaniel the list of the more than two dozen charges he's facing. All but two of those 25 charges occurred in just over 72 hours.
The first shooting happened just after 8 p.m. on Thursday, Sept. 19, at the 604 Bar & Lounge on 9th Street North, according to the Birmingham Police Department.
Upon arrival, officers entered the bar, where they found 35-year-old Diontranet Tinae Brown suffering from a gunshot wound. Brown was taken from the scene with life-threatening injuries and later died at UAB Hospital. McDaniel is charged with her murder.
Just a few nights later, on Sept. 21, gunfire erupted outside Hush, a hookah and cigar lounge, killing four people and leaving 17 others injured. McDaniel has been charged with capital murder and 17 counts of attempted murder.
The following night, officers responded to the South Eastlake area in response to a Shot Spotter alert.
Officers arriving at the scene found 32-year-old Jamarcus McIntyre lying on the sidewalk, suffering from a gunshot wound. He was pronounced dead at the scene.
Officers also located a woman suffering from a gunshot wound in a nearby front yard. She was taken to UAB and treated for non-life-threatening injuries. An injured adult male also arrived at St. Vincent鈥檚 East by private vehicle.
McDaniel is charged with capital murder and three counts of attempted murder in that case. Three additional suspects, Demarco Beck Jr., 29, Ny鈥橯uan Lollar, 22, and Larry Rollins, Jr., 31, face additional charges ranging from capital murder to trafficking heroin.
Those three separate shootings account for 23 of the charges. The other two charges for unlawful possession of marijuana and unlawful possession of a firearm were filed last Friday.
According to court documents, Thursday wasn't McDaniel's first time in a courtroom, he was previously convicted in Bessemer on two counts of attempted murder. That happened in 2019. He pleaded guilty in that case in 2023.
McDaniel was on probation for that murder, but that probation was revoked earlier this week.
In total, McDaniel is facing:
- 2 capital murder charges, one for the mass shooting in Five Points South and one for the shooting that happened the next night in South Eastlake. There is no bond set for these charges.
- 17 felony counts of first-degree assault for the 17 people injured in the mass shooting. The bond for each charge is $30,000 for a total of $510,000.

- 1 count of unlawful possession of marijuana with a bond of $10,000.
The total bond for all of the charges is $1,715,000. Even if McDaniel was able to post that, he still could not get out of jail because of the capital murder charges. The no bond for the capital murder charges is why the prosecution chose not to pursue an Aniah's Law hearing.
Fortune also ordered McDaniel to have no contact with the alleged victims or their families directly or through social media, third parties, other inmates or family members.
McDaniel's next court date is set for Dec. 9 at 1:30 p.m.
