CHARI. THAT鈥橲 RIGHT. I SPENT ALL DAY GOING THROUGH HIS HISTORY. MCDANIEL WAS HALFWAY THROUGH A THREE YEAR PROBATION WHEN THOSE CRIMES WERE COMMITTED LAST MONTH. I SAT DOWN WITH JEFFERSON COUNTY, BESSEMER CUT OFF DISTRICT ATTORNEY LYNNEICE WASHINGTON THIS AFTERNOON TO ASK HER ABOUT THOSE PREVIOUS CASES THAT HAPPENED IN BESSEMER. MCDANIEL STARTED OUT WITH CASES HERE IN THE BESSEMER CUTOFF SOME YEARS AGO. HE WAS PLACED ON PROBATION. HE HAD A SPLIT SENTENCE. DAMIEN MCDANIEL IS CURRENTLY FACING 25 CHARGES FOR A 72 HOUR PERIOD. HE鈥橲 ACCUSED OF KILLING SIX PEOPLE AND INJURING 20 MORE. BUT HIS CRIMINAL HISTORY BEGINS YEARS BEFORE THAT, WHEN HE WAS ONLY 17 YEARS OLD. IN 2019, MCDANIEL WAS ARRESTED ON COUNTS OF ATTEMPTED MURDER IN BESSEMER. DAMIEN MCDANIELS PLED GUILTY ON TWO CHARGES OF ATTEMPTED MURDER AND WITHIN THE BESSEMER CUTOFF JURISDICTION IN 2023. HE WAS SENTENCED TO SERVE 15 YEARS IN THAT CASE, BUT WAS RELEASED AFTER TWO OF THEM. MCDANIELS WAS GIVEN THREE YEARS PROBATION, A PART OF YOUR CONDITIONS OF PROBATION? YOU鈥橰E NOT SUPPOSED TO BE AROUND INJURIOUS AND VICIOUS PEOPLE, NOT BE AROUND AND DISREPUTABLE PLACES, OR AROUND PEOPLE WITH BAD CHARACTER. WASHINGTON SAYS THEY FILED A PETITION TO REVOKE THAT PROBATION LAST WEEK. WE FILED A PETITION TO REVOKE HIS PROBATION BASED UPON THINGS THAT WERE SEEN ON SOCIAL MEDIA. HE WAS IN VIOLATION OF AT LEAST TWO OF THOSE CONDITIONS. AFTER MCDANIEL鈥橲 RECENT ARREST, WASHINGTON SAYS THEY DISCOVERED EVEN MORE WAYS HE WAS VIOLATING HIS PROBATION WHEN THEY EXECUTED THE WARRANT FOR HIS ARREST. THERE WERE GUNS FOUND IN HIS POSSESSION, AS WELL AS MARIJUANA. SO WHY WAS MCDANIEL RELEASED? I FOUND OUT AFTER PLEADING GUILTY. A JUDGE SUSPENDED 13 YEARS OF THAT 15 YEAR SENTENCE. HE WAS ALSO GIVEN CREDIT FOR TIME SERVED, WHICH ALLOWED HIM TO BE PUT OUT ON PROBATION AND RELEASED. MCDANIEL IS BEHIND BARS TONIGHT WITH NO CHANCE OF BAILING OUT AHEAD OF HIS TRIAL. Damien McDaniel was in court on Thursday as a suspect in the Five Points South mass shooting, but it wasn't his first time in a courtroom.McDaniel's criminal history started in 2019 when he was just 17 years old. He was arrested on two counts of attempted murder. He would later plead guilty to both counts in 2023 and be sentenced to 15 years in jail.According to court records, McDaniel received a split sentence. That means he was sentenced to 2 years jail time, and the other 13 years were suspended. He was also given credit for time served, meaning McDaniel was released on a three-year probation.A motion to revoke that probation was filed last week, according to Jefferson County Bessemer cutoff District Attorney Lynniece Washington."A part of the conditions of probation is you're not supposed to be around injurious and vicious people, not be in disreputable places or around people with bad character," Washington said. "He was in violation of at least two of those conditions."In 2021, McDaniel was arrested again after picking up another intentional murder charge. That case was sent to a grand jury, and it was not billed and dropped. Charges were never refiled.Just last month, McDaniel allegedly killed six people over a 72-hour period.The first shooting happened just after 8 p.m. on Thursday, Sept. 19, at the 604 Bar & Lounge on 9th Street North, according to the Birmingham Police Department.Upon arrival, officers entered the bar, where they found 35-year-old Diontranet Tinae Brown suffering from a gunshot wound. Brown was taken from the scene with life-threatening injuries and later died at UAB Hospital. McDaniel is charged with her murder.Just a few nights later, on Sept. 21, gunfire erupted outside Hush, a hookah and cigar lounge, killing four people and leaving 17 others injured. McDaniel has been charged with capital murder and 17 counts of attempted murder.The following night, officers responded to the South Eastlake area in response to a Shot Spotter alert.Officers arriving at the scene found 32-year-old Jamarcus McIntyre lying on the sidewalk, suffering from a gunshot wound. He was pronounced dead at the scene.Officers also located a woman suffering from a gunshot wound in a nearby front yard. She was taken to UAB and treated for non-life-threatening injuries. An injured adult male also arrived at St. Vincent鈥檚 East by private vehicle.McDaniel is charged with capital murder and three counts of attempted murder in that case. He also faces charges of unlawful possession of a firearm and unlawful possession of marijuana, both of which were found in McDaniel's possession when he was arrested.
